fbex.xyz respects the intellectual property rights of others and expects its users to do the same. In compliance with the federal Digital Millennium Copyright Act (“DMCA”), fbex.xyz will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws. If you believe that any content on fbex.xyz has been copied or used in a way that constitutes copyright infringement, please provide us with the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Identification of the copyrighted work claimed to have been infringed;
3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and information reasonably sufficient to permit us to locate the material (such as a URL);
4. Your contact information, including your address, telephone number, and email address;
5. A written statement by you that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;
6. A statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Counter-Notification Process

If you believe that content was removed by mistake or misidentification, you may submit a counter-notice. Your counter-notice must contain the following information:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
2. Your physical or electronic signature (with your full legal name);
3. Identification of the content that was removed or to which access has been disabled, and the location where it appeared before it was removed or disabled;
4. A statement that you have a good faith belief, under penalty of perjury, that the content was removed or disabled as a result of mistake or misidentification;
5. Your name, address, telephone number, and email address, and a statement that you will accept service of process from the person who provided the original notification of alleged infringement.

If a counter-notice is received, we may send a copy to the person who provided the original notification of alleged infringement and inform them that the content may be replaced. Unless the original complainant files an action seeking a court order against the content provider, the content may be restored at fbex.xyz’s discretion within ten to fourteen business days after receiving the counter-notice.

Please note that filing a counter-notification may lead to legal proceedings between you and the complaining party to determine ownership. There may be legal consequences if a false or bad faith allegation is made.

We reserve the right to remove content alleged to be infringing without prior notice and at our sole discretion.
